Licensed Customs brokers are necessary, but, compliance on top of the “reasonable care” element is nevertheless an obligation of the Importer of Record. Your customs broker is only responsible for using “reasonable supervision and control” not in developing your classifications or your internal compliance methods. U.S. Customs and Border Protection (CBP) will hold the importer and not the broker, liable when there are errors performed on entry documentation.
